Trump Struck Down by the Ninth Circus

Whenever a President discovers that a group of people, such as Muslims are entering the United States would be a risk to its citizens, he can suspend indefinitely the entrance of that group. The United States Code § 1182 even states this as fact.

This is what President Donald Trump did. He did not break the law, unless protecting American citizens is unlawful inwhich I’m starting to think that the Democrats want to make protecting Americans unlawful.
 
The 8 U.S. Code § 1182 states that if a president finds that “any class of aliens” who enter the country “would be detrimental to the interests of the United States,” immigration from that group can be “suspended” for a period he “deems necessary.”

This is basic Constitutional law, even a judge for the 9th U.S. Circuit Court of Appeals should know this.

President Donald Trump did just that. He suspended for 90 days the entry of aliens into the U.S. One hundred and twenty days!  Not indefinitely, 90 days, three months.

Actually, President Obama did this first by creating and passing the Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015. Trump just renamed it Executive Order 13769, “Protecting the Nation from Foreign Terrorist Entry into the United States” and passed it off as his own.

A Reuters/IPSOS opinion poll released on Tuesday, Jan. 31, found that roughly one in two Americans backed the ban. It also found that 53 percent of Democrats said they "strongly disagree" with Trump's action while 51 percent of Republicans said they "strongly agree." This is typical, the Democrats opposed the ban and the Republicans supported the ban.

In a national Morning Consult/POLITICO survey conducted Feb. 2 through Feb. 4, similar results were found: Fifty-five percent of registered voters said they approve of the immigration order, while 38 percent disapprove. So according to two different polls, Americans approve of this ban of Muslims.

But who cares about the citizens and the safety of the U.S.? A President George W. Bush appointed federal judge, Judge James Louis Robart of the U.S. District Court for the Western District of Washington ruled in favor of a temporary restraining order on Trump’s EO 13769.

In Trump’s first major presidential upset, a Federal appeals panel on Thursday unanimously rubbed salt into the wounds of the President by rejecting Trump’s bid to reinstate his ban on travel into the U.S. from seven largely Muslim nations.
  The verdict, handed down by the U.S. Court of Appeals for the Ninth Circuit by a left-leaning three-judge panel, Judges William C. Canby, Richard R. Clifton, and Michelle T. Friedland in San Francisco suggesting that the ban did not advance national security.
 

The Ninth Circus has a pretty dodgy past, in 2012 86 percent of its decisions were reversed by the U.S. Supreme Court. The Godless Ninth Circus previously struck down the Pledge of Allegiance. Why?  Because the Godless Ninth Circus is anti-God, it contained the phrase “under God.” The Ninth is also anti-American and anti-Constitutional, it found that citizens have no Constitutional right to own guns. Anti-Second Amendment?

What should Trump do? Well, his EO 13769 wasn’t struck down because it was a ban on religion as Trump campaigned on. It didn’t violate the Establishment clause as many arm-chair Constitutional scholars make the EO out to do. Nowhere does Trump’s EO 13769 explicitly mention "Islam" or "Muslims."

Really, all the judges of the Ninth Circuit said, in a nutshell was we didn’t like the language of the Executive Order. Clean it up. Reword it. Be specific. 

Where were these activist judges when Obama and senators from both parties of Congress passed a law unanimously on December 18, 2015? This is the same, exact law that Trump is using. The seven countries on the Travel Ban are the same ones that Obama listed. 

But not a peep. Only crickets could be heard one week before Christmas.
